My partners 'wife' will not grant him divorce. They have been separated for 3 and a half years now, she is living with another man for most of that period. Why would she not grant divorce? Its nothing to do with anything financial, as that has been sorted out.Why on earth would she want to stay married to him?
Because she is a jerk, he can go ahead with the divorce without her consent either after so many years of separation anyway or if he doesn't want to wait he should talk to a lawyer about the other reasons he can divorce her (such as unreasonable behaviour)Why on earth would she want to stay married to him?
First of all, there may be issues she is not telling you or he is not telling you. Secondly, if he really wants a divorce from her but she won't grant it, he can go to his local county or state office and request them to fight the divorce for him. It will cost him of course, but she has little to no chance against the government.
Thirdly, stay out of it completely, if she finds out you are involved even as a friend to him, it can make things very complicated for him in the divorce proceedings.
Maybe because she does not want to give him the ability to marry you.
As long as he is still married, he's not free to marry anyone else. However, one CAN get divorced without either partner granting it. In most states, it only requires a separation of two years.
IF your ';partner'; truly wanted to be divorced from her, he would have involved an attorney and had it taken care of by now
because not granting the divorce is the only way that she can maintain ';power'; over your partner. however, are you sure that you want to wait around for that divorce to happen? i'm not a lawyer, but in most states there are things that your partner could do to get that decree done, if he was really so inclined. after all, this is not the first time that a situation like this has happened.
If you are in the UK you only have another 18 months before your partner can divorce his ex on the grounds of 5 year separation.
Just wait it out, its not worth causing all this trouble, let it lie and then do it without telling her.

It seems like to me that she may be asking the judge to continue the case because they shold be divorced already .I would tell the man next time he goes to court you wanna go with him and they nay upset the wife really bad and she will just get it over with already
She may have a lot to lose financially. Or, she may just be possessive and not want someone else to have him. Or, she may take her marriage vows seriously-sort of.
Sometimes people are just vindictive.
She still really loves him, or is bitter that he may have a new partner and thus punishing him this way. Im sure after this long it can go ahead with or wothout concent it can in the UK I think??
Only she can say and you would be unwise to find out. 5yrs separation is terminal when one side petitions for divorce regardless of the others' view.
He may have something in the decree that she doesnt agree with, it could be that simple.
he can get the divorce without her signature. sounds fishy to me. maybe she knows he has someone else, and even if she doesn't want him, she may not want anyone else to have him.
she is bitter it happens i am afraid. He will get one automatically after 5 years of separation

Maybe she still loves him. do they have any kids together?
