Since you were married in May, I assume you spent at least one day together since June 30. Neither of you can file as head of household. Your choices are married filing jointly and married filing separately.





Do your returns both ways and see which is better.
You can't file separately as head of household if you're married and living together. In order to be married and file as head of household, you have to be living apart for at least one year (separated). Sorry, it wouldn't be legal to file that way. You have to file as married.

If you did not live under the same roof at any time in the last six months of 2006 then she can file as head of household if she has a dependent(s) living therein with her. You would have to file as married, filing seperate. If you lived under the same roof for even one day in the last six months of 2006 then you have to file as married, filing joint or each of you files as married, filing seperate. In the married, filing seperate you forfeit any tax credits such as EIC, etc.
Both of you pay a higher rate of tax. The lowest rate of tax is reserved for those filing Married filing jointly.
